Oregon court allows challenge to gaming compact

The Oregon Court of Appeals revived a lawsuit that challenges a Class III gaming compact for the Confederated Tribes of Coos, Lower Umpqua and Siuslaw Indians.

A group called People Against a Casino Town questions whether the governor has the authority to enter into compacts. The cite the state constitution's ban on casinos.

The tribe opened the Three Rivers Casino in 2004. Legal challenges to the Indian lands status of the gaming site were rejected in the federal and state courts.

The appeals court decision revived the lawsuit on mostly procedural grounds, the Associated Press reported.
