New York won't take action on Seneca Nation casino

The state of New York won't be taking steps to close down the Seneca Nation casino in Buffalo.

In a July 8 ruling, a federal judge said the Buffalo Creek Casino was built on land that does not qualify under the Indian Gaming Regulatory Act. But state officials said there has been order -- from the court or the National Indian Gaming Commission -- to close the facility.

“Until we have some definitive action from the NIGC, the entity with oversight here, it would be unsafe to pull our gambling inspectors and public safety personnel from an operational casino,” a spokesperson for Gov. David A. Paterson (D) told The Buffalo News.

The state Racing and Wagering Board will maintain five inspectors at the casino.
