Foes ask judge to shut down Seneca Nation casino

Opponents of the Seneca Nation asked a federal judge to shut down the tribe's off-reservation casino in Buffalo, New York.

Opponents asked Judge William M. Skretny to order the National Indian Gaming Commission to take action against the Buffalo Creek Casino. If the NIGC refuses, opponents want the U. S. Marshals Service to come in and shut the facility down.

“My question is what part of ‘illegal’ don’t they understand?” Joel Rose, the co-chairman of Citizens Against Casino Gambling in Erie County, told The Buffalo News.

On July 8, Skretny ruled that the nine-acre casino site does not qualify for gaming under the Indian Gaming Regulatory Act. He said the tribe did not meet an exception that allows gaming on lands taken into trust as part of a land claim settlement.
