D.C. Circuit won't rehear Gun Lake casino case

The D.C. Circuit Court of Appeals has refused to rehear a case that seeks to stop the Match-E-Be-Nash-She-Wish Band of Pottawatomi Indians from building a casino in Michigan.

On April 29, the court rejected a challenge to the tribe's land-into-trust application. Michigan Gambling Opposition filed a request for a rehearing, which was denied last Friday.

MichGO is now asking for a stay of the April 29 decision in order to appeal to the U.S. Supreme Court. It's unlikely the case will be granted.

The tribe, also known as the Gun Lake Band, plans a casino on 147 acres. The Bureau of Indian Affairs has agreed to take the land into trust.
