Judge to rule on Seneca off-reservation casino

Judge William Skretny plans to rule on the status of the Seneca Nation's off-reservation casino in New York by August 26.

Casino opponents want Skretny to close the Buffalo Creek Casino. But the Department of Justice says new regulations allow gaming on the tribe's fee lands in downtown Buffalo.

In a July 8 ruling, Skretny said the site did not qualify under the Indian Gaming Regulatory Act. He said the tribe did not meet the land claim exception in Section 20 of IGRA.

The National Indian Gaming Commission has not taken any action on the casino since the ruling.
