DOJ seeks dismissal of Ponca casino lawsuit

The Department of Justice is seeking the dismissal of a lawsuit that seeks to stop the Ponca Tribe of Nebraska from building a casino.

The states of Iowa and Nebraska sued the National Indian Gaming CommissionIndian Gaming Regulatory Act of 1988.

The casino site was taken into trust after 1988 but it can be used for gaming because the Poncas are a restored tribe, the NIGC said in a December 31, 2007, decision.
