Court tosses case against Oneida casino

Boxing champion Joe Frazier can't sue the Oneida Nation of New York in federal court, the 2nd Circuit Court of Appeals said on Thursday.

Smokin’ Joe said the Turning Stone Resort and Casino used his image without his permission to promote a fight involving his daughter. He objected to the association of his name with gambling.

But the 2nd Circuit said the tribe can't be sued without waiving sovereign immunity. The proper place for the case is tribal court, the decision stated.
