10th Circuit asked to rehear Wyoming eagle case
Thursday, June 26, 2008

A member of the Northern Arapaho Tribe of Wyoming is asking the 10th Circuit Court of Appealsto rehear his religious rights case.

Winslow Friday, 23, shot a band eagle for use in a Sun Dance ceremony. He was prosecuted for taking an eagle without a federal permit.

A federal judge sided with Friday, ruling that the government's permitting scheme infringed on tribal religious rights. But a three-judge panel of the 10th Circuit reversed last month.

Friday wants an en banc panel of the court to rehear the case.
