Hearing set for Pueblo leader's hit-and-run case

A federal judge will hold a hearing on November 3 in the case of a Pojoaque Pueblo leader accused of a fatal hit and run.

Lt. Governor Linda Diaz, 52, pleaded not guilty to a felony charge of leaving the scene of a fatal accident and failing to render aid. Federal prosecutors say she struck Phillip Espinosa, 31, along a highway on the reservation and didn't report the incident until a day later.

Diaz apparently will argue at trial that she didn't know she struck someone. But prosecutors will offer evidence that they say shows she moved Espinosa's body.

Diaz's attorney is Sam Winder, a former federal prosecutor. He is asking prosecutors to explain how the evidence leads to the conclusion that the victim's body was moved.
