Sen. Dorgan not planning to address worries on land-into-trust fix

Sen. Byron Dorgan (D-North Dakota), the chairman of the Senate Indian Affairs Committee, said he's not planning to address concerns about a fix to the U.S. Supreme Court decision in Carcieri v. Salazar.

The decision restricts the land-into-trust process to tribes that were "under federal jurisdiction" in 1934. Dorgan's fix ensures that all tribes, regardless of the date of their federal recognition, can follow the process.

From the start, Dorgan said he would resist efforts to exclude certain tribes from the fix. He reiterated his position this week in response to concerns about the bill.

"We simply can't have all that property and all those tribes with their status in question," said Dorgan, The Providence Journal reported.

The House Interior Appropriations Subcommittee has included the fix in the fiscal year 2011 Interior appropriations bill. Dorgan sits on the Senate Appropriations Committee.
