Appeals court reinstates date for Calif. recall
Tuesday, September 23, 2003

The 9th Circuit Court of Appeals today cleared the way for California's October 7 recall election.

After hearing the case on Monday, a full panel of 11 judges reversed an earlier decision that delayed the election until next March over concern that some voters would be using outmoded machines. The American Civil Liberties Union warned that thousands of urban residents would be disenfranchised unless the equipment was replace.

The 9th Circuit's opinion can be found at http://www.ca9.uscourts.gov.
