Supreme Court calls for new death penalty hearing

A near unanimous Supreme Court on Tuesday ordered a new hearing for an African American man on death row who said his murder trial was tainted by juror bias.

Thomas Joe Miller-El alleges that prosecutors in Texas stacked the jury against him by excluding African Americans. Writing for the majority, Justice Anthony M. Kennedy said the 8th Circuit Court of Appeals was wrong to deny him a chance to challenge his death penalty conviction.

Only Justice Clarence Thomas dissented.
